1. About these terms
Kiln (“Kiln”, “we”, “us”) is a service at kilnmigrate.com for moving the sites on a Laravel Forge server to a new server. It is run by 1994 Limited, a company registered in England and Wales.
These terms apply when you create an account or use Kiln. If you use Kiln on behalf of a business, you accept them for that business and confirm you have authority to do so; “you” then means both you and the business. Our privacy policy and refund policy form part of these terms.
Kiln is built for businesses and professionals who manage servers. You must be at least 18 to use it.
2. Your account and team
- Give accurate details when you sign up and keep your email address up to date: we use it for security and migration emails.
- Every account must use two-factor authentication. Keep your password and authenticator safe, and tell us straight away at [email protected] if you think someone else has access.
- Accounts belong to teams. Team owners and admins decide who joins, what is connected and which migrations run, and are responsible for what members do in the team.
3. Connecting Forge and DigitalOcean
Kiln works through API tokens you give it for your Laravel Forge and DigitalOcean accounts. By connecting a token you:
- confirm you are allowed to use that account and every server and site you migrate with it;
- authorise Kiln to read your servers and sites and to make the changes a migration needs, such as creating servers and sites, adding SSH keys and firewall rules, copying databases and files between your servers, moving reserved IPs and, if you choose, powering off your old droplet;
- accept that Forge and DigitalOcean provide their own services under their own terms, and charge you directly for anything created in your accounts, including new servers.
Kiln only acts on servers when you start or continue a migration. You can disconnect a token from your team settings, or revoke it with Forge or DigitalOcean, at any time. Kiln is not affiliated with or endorsed by Laravel or DigitalOcean.
4. Your responsibilities during a migration
Kiln shows you the plan for each migration, including deploy scripts, environment files, nginx configuration, scheduled jobs and firewall rules, before anything runs. You are responsible for:
- keeping your own current backups of your databases and files before you start a migration;
- checking the plan and the result before you switch traffic, and before you power off or remove an old server;
- your DNS, domains and anything outside your Forge and DigitalOcean accounts;
- the content, code and data on your servers, and making sure your use of them is lawful.
5. Credits and payment
- One migration credit moves one server, however many sites it has. Prices are shown on our pricing page and exclude VAT and sales tax.
- Payments are handled by Stripe, through its Link merchant of record service (“Stripe”), which sells credits to you as the merchant of record. Stripe processes your payment, adds any VAT or sales tax due, and issues your receipt and invoice. Its buyer terms also apply to your purchase. We never see or store your card details.
- Credits belong to the team that bought them. They do not expire, have no cash value and cannot be moved to another team.
- A credit is used when a migration starts. If you abandon a migration before switch-over begins, the credit goes back to your team.
- Refunds are covered by our refund policy.
- We may change prices for future purchases. Credits you have already bought are not affected.
6. Acceptable use
You must not:
- use Kiln on servers, sites or accounts you are not authorised to manage;
- use Kiln to move, host or distribute anything unlawful, or to harm others;
- try to get into accounts, teams or data that are not yours, or test Kiln’s security without our written agreement (we welcome reports of vulnerabilities at [email protected]);
- overload or disrupt Kiln, or get around limits we set;
- copy, resell or reverse engineer Kiln, except where the law allows it.
7. The live demo
The live demo runs against simulated servers and never touches a real one. Demo accounts cannot connect real accounts and are deleted after a day.
8. Changes to Kiln
We keep improving Kiln, so features will change. We aim to keep Kiln available but cannot promise it will always be uninterrupted or error free, and we may need to pause it for maintenance. Forge and DigitalOcean can also change their services in ways that affect what Kiln can do. If we stop offering Kiln, we will give you at least 30 days’ notice and refund any unused credits.
9. Our liability to you
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Subject to that:
- we are not liable for loss of profit, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss;
- we are not liable for loss or corruption of data where a current backup would have prevented it, or for losses caused by Forge, DigitalOcean, your DNS or hosting providers, or changes you make to your servers;
- our total liability to you for all claims in any 12 months is limited to the greater of the amount you paid us for credits in those 12 months and £100.
If you are using Kiln as a consumer, these limits do not affect your statutory rights.
10. Your data
Our privacy policy explains what personal data we collect and why. Where Kiln handles personal data on your behalf while migrating your servers, such as data inside environment files, we act as your processor: we use it only to carry out your migrations, keep it confidential and secure, and delete it when it is no longer needed. Ask us for our data processing terms if you need them.
11. Suspension and closing your account
You can stop using Kiln and delete your account from Account security at any time. Deleting it also deletes every team only you belong to, including any unused credits, so ask for a refund of unused credits first. We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires it. Where we reasonably can, we will tell you why first and give you the chance to put things right. If we close your account without good reason, we will refund any unused credits.
12. Changes to these terms
We may update these terms. If a change matters, we will email account owners at least 14 days before it takes effect. The date at the top shows when they last changed.
13. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring a claim in your local courts.
